Eccleshall Cricket Club

1 Name

The club will be called Eccleshall CC and will be affiliated to the ECB.

2 Aims and objectives

The aims and objectives of the club will be:
• To provide facilities for, and promote participation of the whole community in the sport of cricket
• To manage the Dogcroft Ground
• To ensure a duty of care to all members of the club by adopting and implementing ECB Safe Hands – Welfare of Young People in Cricket Policy and any future versions of the policy
• To ensure that all present and future members receive fair and equal treatment

3 Membership

Membership should consist of officers and members of the club. Membership of the club shall be open to all persons irrespective of ethnicity, nationality, sexual orientation, religion or beliefs; or of age, sex or disability except as a necessary consequence of the requirements of cricket as a particular sport. All prospective members will complete an application form together with a CRB Self Declaration Form before being considered for membership by the Management Committee – admittance approved by 75% majority of the members of that committee present
All members will be subject to the regulations of the constitution and by joining the club will be deemed to accept these regulations and codes of conduct that the club has adopted. The club may refuse membership or expel from membership only for good and sufficient cause, such as conduct or character likely to bring the club or sport into disrepute. Appeal against such a decision may be made to the Appeals Committee as outlined in Clause 9

Members will be enrolled in one of the following categories:
• Full member
• Associate member
• Junior member
• Life member

The club operates a visitors book. Visitors to the club who wish to purchase intoxicating liquor should enter their name and club affiliation in the book, which will then be approved by an existing member. The visitors book contains details such as the time and date of the visit, the full name and address of the visitor, the full name, address and signature of the member authorising the entry

4 Membership fees

Membership fees will be set annually and determined at the Annual General Meeting
Fees will be paid: annually by 30th April

5 Officers of the club

The officers of the club will be:

• President
• Chair
• Vice Chair
• Secretary
• Treasurer
• Welfare Officer
• Fixture Secretary
• League Representative
• Captain 1st XI
• Vice Captain 1st XI
• Captain 2nd XI
• Vice Captain 2nd XI

Officers will be elected annually at the Annual General Meeting
All officers will retire each year but will be eligible for re-election

6 Committee

The club will be managed through the Management Committee consisting of the Officers of the Club listed above other than the President, together with 5 other members to be elected at each Annual General Meeting. In addition, the Management Committee will have authority to co-opt up to 3 additional members to ensure that parents and non-playing members are represented
The Management Committee will be convened by the Secretary of the club and held no less than 8 meetings per year
The quorum required for business to be agreed at Management Committee meetings will be: 5
The Management Committee will be responsible for adopting new policy, codes of conduct and rules that affect the organisation of the club
The Management Committee will have powers to appoint sub-committees as necessary and appoint advisers to the Management Committee as necessary to fulfil its business
The Management Committee will be responsible for disciplinary hearings of members who infringe the club rules/regulations/ constitution. The Management Committee will be responsible for taking any action of suspension or discipline following such hearings

7 Finance

All club monies will be banked in an account held in the name of the club
The Club Treasurer will be responsible for the finances of the club
The financial year of the club will end on: 30th September
The Treasurer at the Annual General Meeting will present an audited statement of annual accounts
Any cheques drawn against club funds should hold the signatures of the Treasurer plus up to two other officers

8 Annual General Meetings

The Club Secretary will give notice of the Annual General Meeting (AGM). Not less than 21 clear days notice to be given to all members
The AGM will receive a report from officers of the Management Committee and a statement of the audited accounts
Nominations for officers of the Management Committee will be sent to the Secretary prior to the AGM
Election of officers is to take place at the AGM
All members have the right to vote at the AGM
The quorum for AGMs will be 15
The Management Committee has the right to call Extraordinary General Meetings (EGMs) outside the AGM. Procedures for EGMs will be the same as for the AGM

9 Discipline and appeals

All complaints regarding the behaviour of members should be submitted in writing to the Secretary
A Disciplinary Committee consisting of the Chair, Secretary and Fixture Secretary will meet to hear complaints within 10 days of a complaint being lodged. The committee has the power to take appropriate disciplinary action including the termination of membership
The outcome of a disciplinary hearing should be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within 10 days of the hearing
There will be the right of appeal to an Appeals Committee following disciplinary action being announced. The committee consisting of the Vice Chair, Treasurer and League Representative should consider the appeal within 10 days of the Secretary receiving the appeal – the decision of the Appeals Committee will be final


10 Not For Profit

The Income and Property of the club, shall be applied solely towards promoting the club’s objects as set forth in this constitution and no portion thereof shall be paid or transferred, directly or indirectly, to the members of the club
11 Dissolution

A resolution to dissolve the club can only be passed at an AGM or EGM through a 75% vote of the membership
In the event of the dissolution of the club, any assets remaining after the satisfaction of all debts and liabilities shall not be paid to or distributed among the members of the club, but shall be given or transferred to Staffordshire County Cricket Board for the future development of youth sport, and cricket within the local community

12 Amendments to the constitution

The constitution will only be changed through agreement by majority vote at an AGM or EGM

13 Declaration

Eccleshall CC hereby adopts and accepts this constitution as a current operating guide regulating the actions of members
